Does look like that new shorter 6 month holding period
might just be a nice loophole.  Today&#039;s E-Trade CEO:

DJ New E*Trade Chairman Layton To Get $1M Annual Fee &gt;ETFC
 
    E*Trade Financial Corp. (ETFC) on Tuesday disclosed that its new chairman, Donald H. Layton, will get an annualized fee of $1 million, and was also awarded 118,934 restricted shares and 321,419 stock options with a one-year vesting schedule. 
 
    E-Trade announced last week that it had named Layton, former vice chairman at J.P. Morgan Chase, to the post of chairman to succeed George Hayter, who will remain on E-Trade&#039;s board.
